Dear Members and Friends,

Are you passionate about arbitration and want to share that with your peers? Or: Have you worked on that big case for many months and are now an expert in the particular field more than anyone else? If you have answered at least one question in the affirmative and can summarize your favourite arbitration-related topic in no more than three sentences, let us know: We would be delighted to hear you speak at one of the next YAAP Roundtables. As you know (and as those who chatted with Flavio Peter on tribunal secretaries at the last Roundtable can confirm), this is a rather informal and relaxed format, ideal for testing and challenging yourself and getting inspired by others. Speakers, we look forward to hearing from you!

Meanwhile, we see you at the Vienna Arbitration Days in the beginning of March or at one of the other upcoming events.

Yours,
Lisa & Filip

Review: YAAP Round Table, in Vienna, at Gustl Kocht, 7 February 2019

On 7 February, the first YAAP Round Table in 2019 saw a lively debate on the use (and potential misuse) of tribunal secretaries. It was triggered by a presentation delivered by Flavio Peter, LL.M. of Wenger & Vieli Rechtsanwälte (Zurich), which was both profound and entertaining, peppered with numerous analogies to well-known contemporary fantasy literature. What are the tasks genuinely reserved to the arbitrator? What is “power” in arbitration after all and should arbitral secretaries exercise power at all? When does administration stop and decision-making commence?
The animated debate confirmed that there is still some ground to be covered in aligning theory and practice, and in forging a true consensus on the subject. If you missed the event (or want to ponder further on the interesting topic), please see the attached file (many thanks, Flavio, for sharing the slides!).
