Dear Friends and Colleagues,

This is the time of the year when – under normal circumstances – we would meet up over our YAAP-ArbAUT-Summer Drinks to look back on the first half of the year. But these are not normal circumstances, although the COVID-situation in Austria has relaxed considerably. We therefore jointly decided to move the summer drinks into the fall. We will keep you posted.

But there is a small consolation: In the meantime, we warmly invite you to our first ever YAAP Summer Hike on 16 July in the Viennese forest. In a small group and open air. Please register, places are limited (see below).
 
After the summer, we hope we will be able to welcome you again at our traditional in-person Round Tables (see below).

UPCOMING: YAAP Summer Hike – 16 July 2020
In a small group we will climb the steep slopes of Nußberg, which offers beautiful views of the city of Vienna and the Danube (easy hike). We will stay outside in the fresh air of the Viennese forest and keep a distance of 1.5m, aka the distance of a baby elephant, at all times. And we will discuss the good, the bad and the ugly of webinars, virtual hearings and zoom birthday parties.
 
Date: Thursday, 16 July 2020
Time & Place: 18:00 - we meet at the terminal station of tram D, Nussdorf, Beethovengang
19:30: By that time we should have reached the Heurigen Wieninger am Nussberg (table booked open air)
Bad weather alternative: None. If it rains, bring your raincoat. It will then be just hiking and no Heuriger.
 
 

SAVE THE DATE: YAAP Round Table – GDPR and Arbitration, 13 October 2020
With a delay of more than half a year, we hope to be able to hold our first in-person round table in the new normal:
 
The General Data Protection Regulation (GDPR) has put data protection in the EU on a new footing and introduced considerable financial sanctions for the processing and transferring of personal data without a lawful basis. Gernot Fritz, Matthias Hofer and Désirée Prantl (Freshfields) will discuss the GDPR’s impact on international arbitration and highlight compliance requirements as well as suggest measures to be implemented at the different stages of an arbitration proceeding.

SAVE THE DATE: YAAP Round Table - White-Collar Crime & Arbitration, 23 November 2020
Oliver Loksa (Hausmaninger Kletter) and Laura Nienaber (White & Case) will analyse several aspects of how white-collar crime impacts our arbitration practice. How should parties and arbitrators react in view of criminal accusations, parallel criminal proceedings or criminal judgements? And: What is the purpose of internal investigations? Will any findings obtained in the course of an internal investigation be admissible as evidence in an ensuing arbitration?

REVIEW: YAAP Webinar on 17 June 2020
Helmut Ortner (Wilmer Hale), Alicja Zielinska-Eisen (Humboldt University Berlin/Linklaters) and Dirk Wiegandt (Hanefeld) explored “The impact of COVID-19-pandemic on arbitral decision making”. Helmut, Alicja and Dirk shared their impressive insights on relevant topics such as force majeure, international law standards and conflict of laws issues arising in connection with the Covid-19-pandemic. The high level presentations were followed by a fruitful discussion, particularly on the scope and nature of Art 79 CISG and the interpretation of emergency clauses.
