REVIEW: Virtual YAAP Round Table - White-Collar Crime & Arbitration, 23 November 2020
Oliver Loksa and Laura Nienaber analyzed how white-collar crime impacts arbitration proceedings: from whether a criminal judgement will have binding effect in the arbitration proceedings, whether the arbitral tribunal should stay the proceedings in face of ongoing white-collar crime investigation (for those who participated and are interested in the recent Spanish case Oliver referred to, in which the court ruled to suspend the arbitration proceedings due to the on-going criminal investigation, this is case nr: STSJ M 3730/2019), to the effects of internal investigations and criminal proceedings on the taking of evidence in international arbitration (buzzword: document production). Thanks a lot to Oliver and Laura for sharing their insights!
