We hope this newsletter finds you well. The time has finally come for us to announce two in-person events; find the details below. We hope (and expect!) you to come out in droves to meet your fellow YAAPies in-person again!
 
And as if this wasn’t enough, there is an opportunity for you to get even more involved in YAAP and secure yourself a place on the YAAP Advisory Board – keep reading for more details (hot tip: point 4 below!). Those of you on LinkedIn will already be informed.
 
1. SIGN UP for our Climate Change “in-person” Roundtable on 4 November 2021 at Café Korb: 

We are delighted to announce that the Climate Change webinar that we postponed in the summer will now take place in-person in our traditional Roundtable format.
 
Amanda Neil (Principal Associate, Freshfields Bruckhaus Deringer LLP) and Markus Beham (Assistant Professor, Chair of Constitutional and Administrative Law, Public International Law, European and International Economic Law, University of Passau)
will be discussing what role arbitration plays in the context of environmental, social and governance issues, in particular climate change.
 
4 November 2021 at 7pm
Café Korb, Brandstätte 7/9, 1010 Vienna
 
The 3-G Rule will apply.
 
2. SAVE THE DATE Arb-Aut, YAAP and VIAC Anniversary Conference, Thursday, 18 November 2021, from 4pm:

We are delighted to be organising another in-person conference with ArbAut and VIAC. As in previous years this event will begin with ArbAut and YAAPs’ annual meetings. The conference will focus on the VIAC’s practice guide on construction arbitration and a presentation of an empirical study on entrepreneurs’ preferred dispute resolution mechanisms in Austria.
 
More details to follow soon.
 
3. CASE LAW TRANSLATIONS IN CO-OPERATION WITH VIAC: 

We are delighted to announce that the project with VIAC in relation to the provision of translations of decisions of the Austrian Supreme Court into the English language is kicking off very soon. Our Advisory Board members Ulrich Kopetzki and Anna Förstel-Cherng will be spear-heading the project for YAAP. The idea is for YAAP members to provide translations of decisions of the Austrian Supreme Court into the English language. The individual will be named as author and the English translations will be published on the VIAC’s website at: Judikatur - Vienna International Arbitral Centre (viac.eu)

4. CALL FOR APPLICATIONS:

As you may be aware, the YAAP Advisory Board consists of seven members. Each member holds this function until they resign or reach the age of 40. Two members of the Advisory Board are appointed as YAAP Co-Chairs for a two-year term. They take care of YAAP’s day-to-day business. The current members of the Advisory Board are Lisa Beisteiner, Filip Boras, Niamh Leinwather, Christian Koller, Ulrich Kopetzki, Yoanna Schuch and Anna Förstel-Cherng.

In January 2021, Christian Koller will leave the YAAP’s Advisory Board and a position will therefore become vacant. All interested YAAP Members are invited and encouraged to become actively involved in YAAP and apply for the vacant position. Your application should consist of a CV and a short letter of motivation emphasising the following criteria:
 
  • a number of years experience in international arbitration with an academic background being of particular advantage;
  • willingness and availability to engage in the organisation and development of YAAP events and projects, and
  • preferably past involvement in YAAP activities.

Applications should be addressed to the current Co-Chairs.
 

The application deadline is Friday, 11 November 2021.
 
The new member of the YAAP Advisory Board will be announced at the upcoming YAAP Anniversary Conference on Thursday, 18 November 2021. We look forward to receiving many interesting applications.

REVIEW: Energy Arbitration in the CEE Region, 7 October 2021, YCAP, YAAP and DIS

On Thursday, 7 October 2021 YCAP - Young Czech Arbitration Professionals, YAAP and DIS hosted an event discussing the topic of energy arbitration in the CEE region. The panel consisting of Lisa Beisteiner, Jan Panáček, Evgenia Peiffer and Yaroslav Petrov focussed on introducing the specifics of energy arbitration to young practitioners. They also discussed the kind of disputes that regularly arise in the energy industry and their typical characteristics. In addition, the panel, which was expertly moderated by Olga Kuchmiienko also addressed the main actors in the field and how they interact. Finally, the speakers offered their thoughts on the future for Energy Arbitration in Europe.

REVIEW: Arb|Aut & YAAP Summer Drinks, 6 August 2021, Summerstage, Vienna:

After a long period of social distancing, YAAP was delighted to meet old friends in 3D and enjoy a few drinks!
 
REVIEW: YAAP case law update, 23 May 2021:

In its seminal decision of 15 May 2019 (18 OCg 6/18h), the Austrian Supreme Court confirmed that arbitral tribunals seated in Austria have the power to adapt contracts. Nicolas Zenz (KWR Karasek Wietrzryk Rechtsanwälte GmbH, Vienna), Katherine Bell (Schellenberg Wittmer, Zürich) and Moritz Schmitt (rothorn legal, Frankfurt) discussed the arbitrator’s power to adapt contracts from a comparative law perspective. Their high-level presentations were followed by an interesting discussion. Those of you, who missed the event, will have the opportunity to read Katherine, Moritz and Nicolas’ impressive insights in the upcoming Austrian Yearbook on International Arbitration.
