REMINDER: YAAP Roundtable - Do all good things come to an end? Termination of Arbitration Agreements - A Case Study
In a recent case pending before the VIAC, claimant terminated the arbitration clause midst proceedings claiming good cause. In subsequent setting aside proceedings before the Austrian Supreme Court, claimant demanded the arbitral award to be set aside on the grounds that – due to its termination – there no longer was a valid arbitration clause in place and the arbitral tribunal, therefore, lacked jurisdiction.
