The Achmea case marks the end of intra-EU investment arbitrations due to their incompatibility with EU law. The exact scope of the decision was, however, heavily debated and many questions remained unresolved. Recently, the ECJ tackled some of these questions in cases PL Holdings, Komstroy, and European Food. If you want to find out whether these decisions were the last nails in the coffin of intra-EU investment arbitrations, please join us at this upcoming YAAP Roundtable.

VIAC Community Ambassador Network (VIAC CAN):
VIAC CAN – and so CAN you!
This new initiative aims at establishing a network of dispute resolution practitioners in CEE and SEE who work closely with VIAC to promote ADR and VIAC in the region. VIAC’s goal is to find an Ambassador in each country in CEE and SEE and create as broad a network as possible. The network will provide individuals in these regions the opportunity to expand their arbitration and mediation knowledge, connect with like-minded peers, and gain an in-depth understanding of VIAC’s offering.

Philipp Schwarz (both Platte disputes.solutions) discussed their insights on the recent decision of the Austrian Supreme Court denying a claim to set aside an award based on Claimant's allegation that the arbitration clause had been terminated on the ground of destitution of Claimant. We truly enjoyed the lively debate on the possibility to terminate arbitration agreements!
